TERMS OF USE OF TCCC FACILITIES

GENERAL RULES & REGULATIONS:

No outside footwear, or the consumption of food and drink is permitted in the gym.
The use of outdoor equipment (i.e. soccer balls, baseballs, rollerblades, etc.) is strictly prohibited.
The consumption and/or sale of Alcoholic Beverages and/or drugs of any kind is not permitted on Tibetan Canadian Cultural Centre (TCCC) property at any time.
Groups are not permitted to sell products available at TCCC.
TCCC is striving to be a smoke free facility. This information must be made known to all individuals using TCCC facilities. If necessary arrangements can be made for a designated smoking area.
TCCC is striving to be a scent-free environment. In recognition of individuals who struggle with asthma, allergies and environmental/chemical sensitivities, please refrain from wearing fragrances and scented products on facility.

II. ADVERTISING:

The Renter shall advertise* only in such mediums that are approved by TCCC and that no billing, distributing or advertising of any kind whatsoever shall be done by the renter without the written consent of TCCC.
*Note: Please advertise your event as "being held at TCCC” held at TCCC” held at TCCC”.

III. LIABILITY AND INDEMNITY:

TCCC has liability insurance to cover incidents where TCCC is held responsible.
The renter, both during and after the term of this agreement, shall be responsible for appropriate liability insurance, covering:

Any and all damage to property,
Injury to persons, including death,
Judgments, claims, demands, causes of action, contracts, suits, actions or other proceedings of any kind (including, but not limited to proceedings of a criminal, administrative or quasi criminal nature) and expenses (including, but not limited to, legal fees on a substantial indemnity basis), which the indemnified person or persons may suffer or incur, howsoever caused.
Renter at their own expense is required to have a general liability insurance and needs to add TCCC as additional insured. The certificate of insurance needs is to be provided before using the facility for the first time.
The Renter shall indemnify and save TCCC harmless, including the TCCC’s board, employees, agents and contractors from and against any loss, cost and expenses incurred by TCCC because of any demand, action or claim brought against TCCC as a result of any loss of or damage to property, personal injury or death, or any other losses or damages , both direct or indirect, including such other costs and expenses, howsoever and whatsoever incurred, suffered or sustained by the Renter using TCCC Facility, or by anyone else permitted on the facility by the Renter or by anyone for whom in law the Renter is responsible, including any losses or damage which have been caused or contributed to by any negligence, negligent misrepresentation, breach of the Occupiers’ Liability Act or breach of statutory duty on the part of TCCC or on the part of anyone for whom TCCC is in law responsible, by the presence of the Renter or anyone else upon the Facility, the conditions or state of repair of the Facility and the Breach of any of the provisions of this Agreement by TCCC, including, but not limited to, any negligent act or omission by TCCC, its or their employees, agents, contractors, or invitees, which causes or contributes to any such injury, damage or loss.

IV. SUPERVISION:

10. The Applicant will be responsible to supervise and control all persons in attendance at their function.

V. ON DUTY STAFF:

11. A Facility Host will be available during your rental to answer any questions.

VI. DAMAGES:

12. The renter is responsible for leaving the property in the general condition of cleanliness and repair in which it was found. All refuse shall be placed in garbage bags (provided) in designated areas. Where additional cleaning of the property is deemed necessary by TCCC, a clean-up charge will apply.

13. Any and all damages caused by the renter will be assessed by TCCC and charged accordingly to the renter on the final invoice.

VII. SIGNAGE:

14. Indoor signage may be provided upon the request of the renter. Outdoor signage is the responsibility of each renter and must be approved by TCCC.

VIII. TERMINATION:

15. TCCC reserves the right to terminate this Agreement at any time (upon 24 hrs of written or verbal notification to the Applicant) with just cause or if there is misrepresentation by the Applicant, in which case monies may be refunded or forfeited at the discretion of TCCC.

16. TCCC reserves the right to terminate any contract if the perceived activities are deemed inappropriate by TCCC. Therein, TCCC also has the right to remove any person or persons it deems objectionable from the premises, in which case TCCC will not be liable for any losses or damages.

IX. PRE-EMPTION:

17. This contract may be pre-empted and terminated at any time in order that TCCC may use the facility for a specific purpose. Wherever possible every effort will be made to give reasonable advance notice of pre-emption and termination.

X. RENT INCREASE:

18. The Renter agrees that any TCCC Board approved rate increase during the term of the contract will be paid upon notice.

XI. PAYMENT:

19. For single event bookings, credit card information is mandatory and will be processed after the event has taken place. Any damages or out of the ordinary cleaning will be assessed, and charged by TCCC on the credit card with the invoice.

20. For multiple event bookings credit card information is not mandatory but another form of payment (cash or cheque) must be indicated and the renter will be invoiced monthly unless alternative arrangements have been made.

21. The booking deposit (if required) will be deducted from the final invoice, which will be sent to you after the event has taken place. The balance must be paid within four (4) weeks from the date of the invoice.

22. Cheques should be made payable to Tibetan Canadian Cultural Centre.

23. We accept Cash, Debit, Cheque and MasterCard only.

XII. CANCELLATIONS:

24. If an event is cancelled two (2) weeks prior the event date, no penalty will be assessed. Cancellations that occur within the two (2) week period before the event date will be charged 50% of the booking. Failure to notify TCCC about a cancellation will result in a 100% charge of the booking.

TERMS OF AGREEMENT : USE OF TCCC FACILITY FOR PROGRAMS

REGISTRATION: I hereby confirm that I am the parent or guardian of the enrolled child. By registering for a classes at the Tibetan Canadian Cultural Centre(TCCC), I give permission to let the enrolled child participate in the specified TCCC Program conducted by a local, independent instructors/teachers and contractors. All provided information included in the registration is correct to my knowledge, and all contact information provided can be used to communicate with me.

By submitting this registration, I am granting to TCCC and to the employees and instructors conducting the programs permission to send me electronic mail. I understand that I can revoke permission to mail to my email address using the unsubscribe feature, or by replying “unsubscribe” at any time.

CONDUCT: By completing the registration, I agree that my enrolled child and family members will abide by the code of conduct of the school, school district, or other facility where the class is held, and that my enrolled child will abide by the instructions of the TCCC instructor and will not be disruptive during any of the TCCC Programs. I acknowledge and understand that improper conduct of the enrolled child and/or family members may result in disciplinary action as determined by the TCCC or facility where the class is held. I acknowledge and understand that improper conduct during a TCCC Program may result in temporary or permanent removal of the enrolled child from the Program as determined by the Young Rembrandts instructor in his or her sole discretion, and that in such case, I will not be entitled to any refunds.

I understand that I am solely responsible for my child’s arrival to and departure from the Young Rembrandts program and will comply with all requirements set forth by the school or other facility to attend and arrive at and depart from class. I will arrange for prompt pick up of my child once the Program is over. I understand that the instructor is not responsible for supervising my child at the facility once the Young Rembrandts Program is over, or for overseeing where my child goes and/or with whom they leave after dismissal from the Young Rembrandts Program.

I understand that in the event my child is unable to attend one or more of the classes for any reason, I will not be entitled to a refund for these absences. In the event of exceptional circumstances that will prevent my child from attending the balance of the classes, I understand that I can contact the TCCC administration conducting the classes to request a refund, but whether a refund will be given will be in the discretion of the TCCC administration.

RELEASE OF LIABILITY: In consideration for allowing my child to enroll in the TCCC Programs, I hereby release and forever discharge and hold harmless TCCC facility, it's employees, directors and any instructors or volunteers or agents from any and all claims or liabilities arising from or in connection with any accident or injury (including injury caused by negligence) occurring while my child is attending the TCCC Program or at the facility where the program is conducted before, during or after the Program.
